Terms of service
1. Who you're buying from
These terms apply to all orders placed in our online shops at uk.valkental.com and us.valkental.com. Your contract is with:
Valkental GmbH
Rheinpromenade 9, 40789 Monheim am Rhein, Germany
Commercial register: Amtsgericht Düsseldorf, HRB 95926
UK VAT number: GB529999510
German VAT ID: DE351333799
Email: support@valkental.de
The version of these terms that applies is the one published when you place your order.
2. How your contract is formed
- The products in our shop are not a binding offer; they invite you to order.
- Add products to your cart and go to checkout. Before you pay, you see all your details and the total, and you can correct any input errors. By clicking the final payment button, you make a binding offer to buy the items in your cart.
- Right after that you get an order confirmation by email. It confirms that we've received your order; it does not yet accept it.
- The contract is formed when we accept your order by sending you the shipping confirmation or by dispatching the goods.
- If we can't accept your order, for example because an item is no longer available, we let you know straight away and refund any payment already made.
- The contract language is English. We store your order details; you receive them in your order confirmation and can view your orders in your customer account at any time.
3. Prices and payment
- Prices are shown in pounds sterling (GBP) at uk.valkental.com and in US dollars (USD) at us.valkental.com.
- Import duties and taxes are included in the total shown at checkout. Shipping costs, if any, are shown at checkout before you pay.
- You can pay with the payment methods shown at checkout. Payment is due when you place your order and is charged at that point.
- If a product is listed at an obviously wrong price, we contact you before dispatch. You can then buy at the correct price or cancel, and we refund any payment in full.
4. Delivery
- We deliver to addresses in the United Kingdom and the United States. Delivery times and shipping details: Shipping policy.
- The goods travel at our risk until they're delivered to you.
- The goods remain our property until paid for in full.
5. Returns and your right to cancel
You can return items within 30 days of delivery. If you live in the UK, you also have a statutory 14-day right to cancel. Both are explained in our Refund policy; a model cancellation form is available.
6. Faulty goods and guarantees
- You have the statutory rights of the country you live in for goods that are faulty or not as described. Contact us with your order number, a short description and photos, and we'll put it right.
- If a parcel arrives visibly damaged, please report it to the carrier on delivery if you can, and let us know. If you don't, your rights are not affected; it just helps us claim against the carrier.
- We only give an additional guarantee where we expressly state one for a product.
7. Product information
- Our photos show the products as accurately as we can. Shades can look slightly different on your screen.
- The reflective elements of our jackets make you easier to see when light, for example from headlights, hits them. They don't replace the lights and reflectors your bike needs, and they can't guarantee that other road users will see you.
- Please follow the care instructions on the label so the jacket keeps its waterproof and reflective properties.
8. Discount codes
- Discount codes must be entered before you complete checkout; they can't be applied afterwards.
- One discount code can be used per order. Codes can't be combined, exchanged for cash or applied to past orders.
- If you return items bought with a discount code, we refund the amount you actually paid.
9. Liability
- We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under product liability law and where we have given a guarantee.
- For slight negligence we are only liable if we breach an obligation that is essential to the contract and that you can regularly rely on. In that case our liability is limited to the damage that is typical for this kind of contract and foreseeable.
- Nothing in these terms excludes or limits liability that cannot be excluded or limited by the law of the country you live in.
10. Applicable law and disputes
- These terms and your contract are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). As a consumer, you keep the protection of the mandatory provisions of the law of the country where you live.
- As a consumer, you can bring legal proceedings in the courts of the country where you live.
- We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. Write to us at support@valkental.de and we'll find a solution with you.
11. Final provisions
If any provision of these terms is invalid, the rest of the terms remain valid.
